TideWatch Partners, LLC (“TideWatch”) respects the privacy of information that identifies you or is identifiable to you. TideWatch has created this policy disclosing its information gathering and dissemination practices in compliance with the various laws that govern our processing of your Personal Information (Data Privacy Laws). Please read this Privacy Policy (Policy) carefully to understand TideWatch’s practices.

2. Information TideWatch May Collect

TideWatch conducts market research studies on behalf of its client (Research). In the course of conducting and managing Research, we collect, receive and process limited categories of Personal Information that are necessary for us to conduct and manage the Research. This information could include first and last name; age; gender; mailing address and email address. Additionally, we may collect and process certain technical and usage data when you access our website, including your IP address, the time, assorted technical information, and information about the page you requested. Such technical and usage data does not contain your name or Personal Information, and is considered anonymous information.

3. Sensitive Information Processed

In the course of conducting and managing Research, we may collect, create, or process Personal Information that is of a sensitive nature (Sensitive Personal Information). Such information could include information about individuals who are minors in the jurisdiction where they reside (Children). Except as otherwise provided in this Section, TideWatch does not knowingly, receive, collect, create, or process any other categories of Sensitive Personal Information, including information about any of the following: race; ethnic origin; national origin; gender; sexual orientation or identity; sex life or activity; religion or religious affiliation; political opinions or affiliation; philosophical beliefs; trade union membership or affiliation; physical or mental health; biometric information; and specific geolocation. For the purposes of this Policy, Sensitive Personal Information is a category of Personal Information.

4. How we collect your Personal Information

We may collect Personal Information from you that you voluntarily provide directly to us, including when you participate in our Research, complete surveys or questionnaires, engage in interviews or focus groups, inquire about our Research, or otherwise interact with us, such as through email or other direct communication. Additionally, we may automatically collect limited categories of Personal Information, such as technical and usage data, when you interact with our website or online platforms.

5. Purpose of Processing

We may process Personal Information to: (1) provide, conduct, carry-out, manage, develop, maintain, and improve the Research and methodologies used to conduct the Research; (2) analyze and report findings of the Research; (3) communicate with you about your participation in the Research, including scheduling, reminders and follow-ups; (4) provide support for your participation, including responding to inquiries, feedback, and other issues; (5) process and complete transactions related to your participation, such as issuing compensation or rewards and providing related information; (6) personalize your experience with the website; (7) send you communications about upcoming Research opportunities or other information; (8) maintain the safety, security, and integrity of our Research, and our website; (9) comply with legal and regulatory obligations, and (10) establish, enforce, and otherwise exercise our rights and defend against claims.

6. Legal Basis for Processing Personal Information

We will only process your Personal Information when we have a legal basis to do so. Accordingly, we may process your Personal Information based on the following basis:

  • Performance of Contract. We process Personal Information in order to perform our obligations under a contract with the Client, including a contract to conduct or manage Research. As a result, we process Personal Information in order to fulfill our statutory, contractual, common law, and other commercial and legal relationships and duties.
  • Legal or regulatory obligation. We may process your Personal Information where we need to comply with legal or regulatory obligations that we are subject to.
  • Legitimate interests. We may process your Personal Information where necessary for our interests (or those of a third-party), provided that your fundamental rights do not override such interests. Such legitimate interests include, but are not limited to, the following: (1) conducting Research on behalf of Clients; (2) understanding and responding to inquiries; (3) improving or developing the Research or to ensure its safety; (4) ensuring our systems are safe; (5) enforcing our terms of engagement and website and other terms and conditions; (6) developing relationships with business partners; and (7) sharing data in connection with acquisitions and transfers of our business.
  • Consent. In addition to the foregoing, we seek and obtain consent for the use of Personal Information if and to the extent consent is required for processing of Personal Information under Data Privacy Laws.
7. Disclosure of Personal Information

Except as necessary or appropriate to provide Services, we do not disclose Personal Information that we received from or collected from you to any other unaffiliated third party, provided that we may disclose Personal Information for the following purposes and in the following circumstances:

  • To the Client on whose behalf, we conduct or manage the Research.
  • If directed to do so by the individual about whom such Personal Information pertains or that individual’s legal representative.
  • If required to do so by Data Privacy Laws, any other law, rule, or regulation, legal process or warrant, or order of any court or governmental agency or authority.
  • To our agents and service providers necessary or appropriate in order to conduct or manage the Research, such as information technology and security providers, data hosting service providers, providers that process payments, attorneys, accountants, tax professionals, financial advisers, or any other third party that is necessary or appropriate for us to disclose Personal Information to in order to conduct or manage the Research. Unless we tell you differently, our agents and service providers do not have any right to use the Personal Information we share with them beyond what is necessary to assist us in conducting or managing the Research.
  • In connection with a sale, merger, consolidation, change in control, transfer of substantial assets, reorganization, or liquidation of TideWatch.
  • To entities that perform marketing, advertising or market research on our behalf.
  • If we determine that doing so would be in the public’s interest.
  • For protection of TideWatch, the public, and others.
8. Privacy Rights

Depending on the Personal Information that we have about you, and depending on the manner in which we process your Personal Information, you may have the following privacy rights related to our processing of your Personal Information:

  • Information. Be informed about how your Personal Information is being processed, the categories of Personal Information being processed, and the categories of sources from which your Personal Information has been collected. Additionally, you have the right to be informed about whether and how your Personal Information being processed is being sold, shared, traded, disclosed, exchanged or brokered with unaffiliated third parties, and which categories of your Personal Information are being sold, shared, traded, exchanged or brokered with unaffiliated third parties.
  • Access. Access or receive a copy of your Personal Information. Where applicable, we will provide the information in a portable, machine-readable, and in a commonly used format.
  • Correction. Rectify or correct inaccurate or incomplete Personal Information about you.
  • Deletion. Erasure or deletion of certain of your Personal Information.
  • Objection. Object or opt-out of the sale, sharing, trading, exchange, and brokering of your Personal Information with unaffiliated third parties, including for marketing purposes.
  • Restriction. Limit or restrict processing of your Sensitive Personal Information.
  • Withdraw consent. If we rely on your consent as our legal basis for processing your Personal Information, you have the right to withdraw that consent at any time. However, such withdrawal will not affect the lawfulness of our use and processing of your Personal Information before such withdrawal.

To make a request concerning these rights, please complete and submit the Privacy Rights Request Form on our website. We will confirm receipt of all such complete Privacy Rights Request Forms within 10 business days of receipt. We will substantively respond to all such requests within 30 days, subject to any lawful extension of that period. Additionally, there may be a delay in processing a request while we verify that the request is valid and originates from you as opposed to an unauthorized person.

Please be aware there may be valid reasons to refuse a request, including legal and regulatory requirements that we retain and process certain information. Also, please be aware that certain requests may limit or prevent your participation in the Research. In those situations, we will notify you in writing within 30 days, subject to any lawful extension of that period. You may also contact our Data Privacy Officer for help with those situations.

We will not discriminate against you if you exercise any of the foregoing rights or any other rights under Data Privacy Laws, including, by not denying services to you, not providing a different level or quality of services to you, and not suggesting that you will receive a different level or quality of services.

9. Selling, Sharing, Trading, Exchanging and Brokering Personal Information

We do not disclose or sell Personal Information that we received from or collected from you to any other unaffiliated third party. If and to the extent you want to opt-out of the sale, sharing, trading, exchanging, or brokering of your Personal Information, please complete and submit the Privacy Rights Request Form on our website, and we will address such requests as described in the foregoing section of this Policy.

10. Market Research

TideWatch adheres to the mandated Market Research Association (“MRA”) code of Standards and Ethics for Survey Research. This code includes requirements for protection of Personal Information and respondent identifiable information. A copy of this code can be found here.

All participant responses will be kept strictly confidential and only reported in the aggregate— that is, information about groups and not individuals—unless otherwise stated within the survey. Where we share or disclose a participants Personal Information to the Client, we ensure that the information is treated with the strictest of confidence. We will not mislead a participant regarding the nature of the research or how the information will be used.

To the extent required by Data Privacy Laws, Personal information will not be sold, shared, disclosed or traded to any other individual or unaffiliated third-party without the prior consent of the individual about whom such Personal Information pertains.

11. Automated Decision Making

We do not use automated decision making or profiling in the processing of your Personal Information, and do not make decisions that affect you based on automated decision making or profiling using your Personal Information.

12. Duration of Retention

We will only retain your Personal Information for as long as necessary to fulfil the purposes we collected it for. To determine the appropriate retention period for Personal Information, we consider the amount, nature and sensitivity of Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements. 13. Privacy Practices of Third Parties

TideWatch’s website may feature links to third-party sites that offer goods, services, or information. TideWatch is not responsible for the content, privacy policies or practices of any advertisers or linked sites of any third parties. TideWatch encourages you to review the privacy policies of third parties before providing any third party with any information. Third party sites may collect and use information about you in a way that is different from this policy.
