Welcome to the TideWatch website (the “Website”), which is owned, hosted and managed by TideWatch Partners LLC.
This Privacy Policy describes how we collect and use information about users of the Website. By using the Website, you accept and agree to be bound by this Privacy Policy as well as the Terms of Use for the Website.
The Website is accessible to registered members only. To become a member, you must be a legal resident of the United States and must be at least 18 years of age (or the age of majority in your state of residence).
NOTICE TO CALIFORNIA RESIDENTS – YOUR CALIFORNIA PRIVACY RIGHTS:
Under California Civil Code Section 1798.83 (known as the “shine the light” law), California residents have a right to request an information-sharing disclosure from a business to which they have provided personal information and which has shared the information in the prior calendar year with one or more third parties for direct marketing uses.
We do not knowingly share our members’ personal information collected on or through the Website, with third parties for such third parties’ direct marketing uses, unless we first obtain our members’ opt-in consent.
Any request for an information-sharing disclosure under this law should be sent to us via email at twp@tidewatch.com. Please note that under this law, we are not required to respond to a California resident’s request more than once in a calendar year, nor are we required to respond to any request that is not sent to the email address designated above.
Do Not Track Disclosure: The Website does not currently respond to “Do Not Track” signals of web browsers. However, should the industry establish uniform technological standards for recognizing and implementing “Do Not Track” signals, we would be open to following such industry standards.
1. INFORMATION WE COLLECT
1.1 Personally Identifiable Information (“PII”): This is information that identifies you personally, such as your name, email address, phone number, mailing address, profile photo, and biographical information. We collect PII that you provide to us when you engage in an identification activity on the Website, such as registering to become a member, answering a survey, or submitting questions, comments, opinions or ideas to us (each, an “Identification Activity”). Whether or not to disclose PII is completely your choice. However, without providing PII, you will not be able to engage in or complete an Identification Activity.
NOTE: The Website may allow social media functionality that enables members to log in and connect their member accounts on the Website with their accounts on third-party social media services (such as Facebook, Twitter, etc.). If you use such social media functionality, we may receive/collect your user IDs/usernames, profile information, likes, friends’ lists, etc. associated with third-party social media services (collectively “Social Media Information”). By using such social media functionality, you are authorizing TideWatch to collect, store, and use your Social Media Information in accordance with this Privacy Policy.
1.2 Aggregate and Anonymous Information (“AAI”): This refers to information that does not identify you personally. For example, we and/or our service providers (e.g., TideWatch) collect anonymous group data (demographics, interests and preferences, etc.) about users of the Viewer Panel Website, as well as traffic data such as total page views in a given time period; average amount of time users spend on the Website, how many times a particular piece of content on the Website was viewed or downloaded by our users, etc. Moreover, we and/or our service providers (e.g., TideWatch) may combine UAI (as defined below) about you and other users of the Website to generate aggregate information that reflects activities, habits, preferences, interests, etc. about our users as a group. In addition, we may take PII and make it non-personally identifiable, such as by aggregating your information with information about other individuals, or by removing personally-identifiable elements (such as names) so as to “anonymize” or “de-personalize” your information.
1.3 User Activity Information (“UAI”): This refers to information we collect about user activities on the Website. For example, we and/or our service providers (e.g., TideWatch) may use cookies and/or similar technologies to collect “clickstream data” about users of the Website, such as: IP addresses (which are numerical numbers that are automatically assigned to users’ computers and mobile devices when they are surfing the Internet), the type of browser you are using (e.g., Firefox, Internet Explorer), the type of operating system you are using, (e.g., Microsoft Windows or Mac OS), the domain name of your Internet service provider, the web pages you have visited, the content you have accessed and the advertisements you have been shown and/or clicked on, etc. See the “Cookies and Similar Technologies” section below for more information.
NOTE: To the extent we use UAI in a manner that identifies a person individually (e.g., if we link or associate such information with name or address), such information will be treated as PII.
Otherwise, UAI will be treated as AAI.
2. WHAT WE DO WITH THE INFORMATION
The following describes how we use and share our members’ information (including PII) collected on or through the Website:
To conduct market research: By becoming a member of the Website, you expressly acknowledge and agree that we may retain and use your information (including PII) indefinitely for market research purposes to help us and our licensors and business partners better understand the needs and interests of our viewers. Market research is crucial in helping us and our licensors and business partners develop new content that appeals to our audiences.
To operate, manage, maintain and improve the Website: This includes using information (including PII) to enable and support our members’ Identification Activities. For example: (i) when you register to become a member, we will use your information to set up, administer, service, and communicate with you regarding, your member account; (ii) when you participate in a survey, we will use your and other participants’ information in connection with the survey, including (but not limited to): compiling and analyzing participant data and survey results; entering participants into the prize drawing associated with the survey; communicating with you regarding your answers submitted in the survey; and notifying you should you be selected as a winner in the associated prize drawing; and (iii) when you submit questions, comments or ideas to us, we will use your information to process and respond to your submissions.
To communicate and keep in touch with our members: This includes communications with our members in connection with their Identification Activities, as described above. Other examples of communications with our members include (but are not limited to): inviting members to participate in upcoming surveys; informing members about changes and updates to the Website, including material changes in this Privacy Policy and/or the Terms of Use for the Website; informing members in the event of an actual or suspected security breach that affects their PII stored by or for us; and informing members about TideWatch news and programs and services in general.
To allow social media functionality: The Website may allow social media functionality that enables users to log in with or connect their social media accounts with their member accounts on the Website. By using social media functionality, you acknowledge and agree that we may share your TideWatch account information (including PII) with applicable third-party social media services, and you understand that their use of the shared information will be governed by their own privacy policies.
To share with survey co-sponsors: From time to time, we may conduct surveys with one or more third-party co-sponsors (each, a “Co-Sponsored Survey”). As a condition of participation in a Co-Sponsored Survey, we will require your opt-in consent to allow us to share your information (including PII) collected from the survey with our cosponsor(s), with the understanding that our co-sponsor(s) may use your information for its/their own purposes and that we will have no control over such use by our cosponsor(s).
To enable our service providers to provide services and support for the Viewer Panel Website: Our service providers (e.g., TideWatch) may need to access our members’ information (including PII) in order to provide services and support for the operation and maintenance of the Website. We require that our service providers limit their use of our members’ PII solely to providing services and support to us and that they use reasonable measures to safeguard the information and not make unauthorized use or disclosure of the information.
To deliver interest-based advertising: We and our service providers may use our members’ information (including PII) to deliver advertising that is tailored to our members’ interests. For example, subsequent to their visits to the Website, our members may see TideWatch advertisements on a third-party website.
To protect our rights, etc.: We may disclose our members’ information (including PII) if doing so, in our good faith belief, is necessary to: (i) protect our rights or property, or protect the security or integrity of the Website, or protect the safety of ourmembers and/or the public (including enforcement of the terms of this Privacy Policy and/or our Terms of Use); (ii) detect, prevent, or address fraud, security or technical issues, or for risk management purposes; (iii) comply with law or legal process (including a court order or subpoena); and/or (iv) to cooperate with law enforcement (including investigation of an alleged or suspected crime, fraud or other illegal activity).
To complete a merger, sale of business or assets, etc.: If we are involved in a merger, acquisition, financing, or sale of business or assets, our members’ information (including PII) may be transferred to one or more third parties involved in such transaction and, upon such transfer, the relevant third-party privacy policy or policies may govern further use of the information. In the event of such a change of ownership, we will endeavor to notify our members of the change as well as any choices our members may have regarding the change.
Use and sharing of AAI: Because of the anonymous, non-personally identifiable nature of AAI (including UAI that is not personally identifiable), there are no restrictions under this Privacy Policy on how we may use and share AAI (including UAI that is not personally identifiable).
3. INFORMATION ACCESS; MEMBERSHIP CANCELATION; DATA RETENTION; NOTICE AND CHOICE
3.1 Information Access: To view and update your member information, please log into your member account and go to “My Profile” which is located on the main navigation bar at the top of the Website. Alternatively, you can email us at twp@tidewatch.com.
3.2 Cancellation of Membership: If you decide to cancel for any reason, please email us at twp@tidewatch.com (subject: ‘cancel membership’). We will deactivate your account upon receiving and processing your cancellation request. You may re-register on the Viewer Panel Website, but because membership is limited, re-admittance is not guaranteed.
3.3 Data Retention: Notwithstanding your cancellation of membership, you acknowledge and agree that: (i) we may retain and continue to use your information (including PII) indefinitely for market research purposes; (ii) we may also retain your information (including PII) if doing so, in our good faith belief, is necessary to comply with law or legal process (including a court order or subpoena), to cooperate with law enforcement investigation of an alleged or suspected crime, fraud or other illegal activity, to complete a pending transaction between you and us, to resolve a claim or dispute between you and us, and/or to enforce an applicable agreement between you and us; and (iii) we may retain AAI (including UAI that is not personally identifiable) indefinitely.
3.4 Notice and Choice: This Privacy Policy is the primary means by which we provide you with notice and choice regarding our collection and use of your PII. We will not use your PII in a manner that is materially different than as described in this Privacy Policy without providing you with notice and choice.
Choice re. Our Marketing/Promotional Emails: To opt out from receiving marketing/promotional emails from us on a going-forward basis, please email your request to us at twp@tidewatch.com or use the “unsubscribe” link provided in a marketing/promotional email you previously received from us.
Choice re. Our Mobile Messaging: If you sign up for one of our mobile messaging/alert programs, you may cancel and terminate your participation in such program at any time by replying STOP to a mobile message you have received, or by texting STOP to the short code used for the messaging program from which you wish to opt out (if you have enrolled in multiple messaging programs on the same short code and wish to opt out from all those programs, text STOP ALL to the short code).
We will endeavor to process your request as soon as reasonably practicable upon receipt (or within such time as required by applicable law).
NOTE:
Your opt-out regarding our marketing/promotional emails will NOT stop email communications from us of a transactional or relationship nature or as required by law, which include (but are not limited to): communications regarding your member account or your participation in a survey or a prize drawing; communications responding to questions, comments or ideas you have submitted to us; member notifications about changes and updates to the Website, including material changes in this Privacy Policy and/or the Terms of Use for the Website; and member notifications in the event of an actual or suspected security breach that affects their PII stored by or for us.
If you participate in a Co-Sponsored Survey and consent to our sharing of your information with our survey co-sponsor(s), you must contact our co-sponsor(s) directly in order to opt out from its/their marketing/promotional type communications.
4. COOKIES AND SIMILAR TECHNOLOGIES
4.1 Our Use of Cookies and Similar Technologies: Cookies are small data files that websites and online services send to and store on your computer or mobile device through your Web browser (if you allow). Cookies enable websites and online services to recognize your browser and record certain information about your visits. We and our service providers (e.g., TideWatch) use cookies on the Website to help us remember who you are, to enhance and personalize your experience, to understand and save your preferences for future visits, to compile information about our users, and to carry out other tasks relating to the operation or improvement of the Website. We may also use information collected from cookies together with PII we have collected from our users. We do not, however, use cookies to access information on your computer or mobile device. Most web browsers are initially set to accept cookies, but you can change your browser settings to notify you when you are sent a cookie, giving you the ability to accept or reject it, or you can choose to routinely and manually delete cookies stored on your computer or mobile device. We may also use “web beacons” (also known as “clear GIFs,” “pixel tags,” etc.) – which are small bits of code embedded in web pages or in emails – to deliver or communicate with cookies, to count users who have visited a web page, and to understand usage patterns. We may include web beacons in emails to help us recognize activities such as when an email was opened, how many times an email was forwarded, which links in the email were clicked on, etc. Web beacons cannot be declined when delivered via a regular web page. However, web beacons can be refused when delivered via email. If you do not wish to receive web beacons via email, you will need to disable HTML images or refuse HTML (select Text only) emails via your email software.
4.2 Third-Party Use of Cookies and Similar Technologies: We may allow third parties including so-called “network advertisers” or “ad networks” (collectively, “Third-Party Advertisers”) to serve and manage advertisements on the Website. Third-Party Advertisers may set and use their own cookies, web beacons, etc. on your computer or mobile device when you interact with their ads. These third-party cookies, web beacons, etc. allow Third-Party Advertisers to recognize your computer or mobile device each time they send you an ad and to compile information about your interactions with their ads. Use of cookies, web beacons, etc. by third-party advertisers is governed by the privacy policies of such third-party advertisers – and not by this Privacy Policy. We have no control over what information is collected by third-party advertisers or how they may use the information. The privacy policies and data practices of third-party advertisers may significantly differ from those of TideWatch, and we make no representation or warranty whatsoever about third-party advertisers’ data policies and practices.
In addition, Third-Party Advertisers may use cookies, web beacons, etc. to collect, compile and use information about your activities on the Website and on third-party websites and services for purposes of serving you interest-based advertising. 4.3 Use of Google Analytics: We and our service providers (e.g., TideWatch) use Google Analytics to collect and analyze information about our users’ demographics and interests, in order to measure and improve the Website. We may also use Google Analytics for Display Advertising features, such as Remarketing, Google Display Network Impression Reporting and/or the DoubleClick Campaign Manager integration. Google requires the following discloses regarding use of any Google Analytics for Display Advertising features:
You may opt out of Google Analytics for Display Advertising or customize Google Display Network ads by using the Google Ads Settings page at https://www.google.com/settings/ads?hl=en. You may also prevent your data from being collected and used by Google Analytics by opting out through the use of the Google Analytics Opt-out Browser Add-on which can be downloaded at https://tools.google.com/dlpage/gaoptout.
If we use the Google Analytics for Display Advertising Remarketing feature, we will use such Remarketing feature to advertise online and third party vendors, including Google, may show TideWatch ads on sites across the Internet.
We and third party vendors, including Google, may use first-party cookies (such as the Google Analytics cookies) and third-party cookies (such as the DoubleClick cookie) together to (i) inform, optimize and serve ads based on a user’s past visits to the Viewer Panel Website, and/or (ii) report how your ad impressions, other uses of ad services, and interactions with these ad impressions and ad services are related to visits to the Viewer Panel Website.
Data from Google Analytics Demographics and Interest Reporting may be utilized by us to help recognize and understand user preferences, to make improvements to the Viewer Panel Website, to choose content and advertising to display to you, and for other business purposes that will allow us to better serve you.
5. SECURITY
We and our service providers (e.g., TideWatch) use commercially reasonable measures to safeguard the security of PII that our members have provided to us. However, no security measures are perfect or impenetrable. We and our service providers cannot guarantee that only authorized persons will view your information or that information you share on the Viewer Panel Website will not become publicly available. We and our service providers are not responsible for third party circumvention of any privacy settings or security measures on the Viewer Panel Website. You can reduce security risks by using common sense security practices such as choosing a strong password using a combination of letters and numbers, changing your password often, using different passwords for different services, using up to date antivirus software, and using an SSL-enabled browser. Also, you should never share your member account log-in information with anyone that you do not trust.
We will endeavor to notify you if and to the extent required by law, in the event we become aware of a breach or suspected breach of the security of your PII stored by or for us. However, we are not liable for any breach of the security of your personal information resulting from causes or events that are beyond our control, including, without limitation, your own act or omission, corruption of storage media, defects in third-party data security products or services, power failures, natural phenomena, riots, acts of vandalism, hacking, sabotage, or terrorism. By providing your email address to us, you acknowledge and agree that we may notify you via email in the event of a breach or suspected breach of security involving your PII stored by or for us.
6. LINKS TO THIRD-PARTY PRODUCTS AND SERVICES
For your convenience, the Website may provide links to websites, apps, and other products and services owned or operated by third parties (each, a “Linked Third-Party Product/Service”). Such linking does not mean, and should not be deemed or construed to mean, that we endorse or approve or are affiliated with a Linked Third-Party Product/Service. We neither control nor are responsible for any Linked Third-Party Product/Service. Specifically, we are not responsible for the data privacy and security policies or practices of the provider of a Linked Third-Party Product/Service. When you leave the Website to visit a Linked Third-Party Product/Service, this Privacy Policy no longer applies, and any information collected from or about you by the provider of a Linked Third-Party Product/Service will be governed by and subject to the privacy policies and practices of that provider, which may be substantially different from those of TideWatch. The provider of a Linked Third-Party Product/Service may set or use its own cookies, web beacons, etc. to your computer or mobile device, and may collect information from and about you and use the information in ways that we would not. You access a Linked Third-Party Product/Service entirely at your own risk. You should always read the privacy policy associated with a Linked Third-Party Product/Service before disclosing any personal information.
7. PROTECTING CHILDREN
The Website is intended for users who are at least 18 years of age, and are not intended for or directed to children under 13. We do not knowingly collect personal information from anyone under the age of 13.
8. CHANGES TO THIS PRIVACY POLICY
From time to time, we may update and modify this Privacy Policy to accommodate new technology, industry practices, regulatory requirements, or for other purposes. We will provide you with notice if the changes are material and, where required by applicable law, we will obtain your consent (e.g., we may ask you to affirmatively consent to the changes by checking a box or clicking a button at the time of your next account login on the Website). Unless expressly otherwise agreed, all material changes will apply prospectively only.
